TERMS OF SERVICE

Terms of Service for Commissioning ArtworkThese Terms of Service ("Terms") govern the commissioning process between Vesper Possum, a digital artist ("Artist"), and the individual or entity commissioning artwork ("Client"). By commissioning artwork from the Artist, the Client agrees to be bound by these Terms.1. Commissioning Process:
Communication: All communication between the Artist and Client, unless otherwise specified, will be through Discord or Twitter.
Payment: Payment is to be made through PayPal or Patreon only.
Consultation: The Client and Artist will discuss the specifics of the commission, including subject matter, style, and any other relevant details.
Deposit: The Client agrees to pay a non-refundable deposit of 50% of the total commission price upfront to secure a spot in the Artist's queue.
Initial Sketch: Upon receipt of the deposit, the Artist will provide the Client with an initial sketch for approval.
Revisions: The Client is entitled to up to three rounds of revisions during the creation process.
Final Payment: Once the final artwork is approved by the Client, the remaining 50% of the total commission price is due.
Optional Revision: After the final payment, the Client may request one additional round of simple revisions if needed.
Delivery: The completed artwork will be delivered to the Client within 4-6 weeks from the date of initial payment, unless otherwise stated.
2. Rights and Usage:
The Artist retains all rights to the commissioned artwork, including but not limited to reproduction rights, unless otherwise agreed upon.
The Artist may use the commissioned work in their portfolio, website, or for marketing purposes, unless the Client opts for privacy (see Section 3).
The Client has the right to display the commissioned artwork in their personal gallery or social media, provided proper credit is given to the Artist with a link to the original image or one of the Artist's websites.
3. Privacy Option:
For private commissions, where the Client wishes to keep the artwork confidential, a 35% fee will be added to the total commission price.
4. Commercial Use/Work for Hire:
For commissions intended for commercial use or as work for hire, the Client must reach out to the Artist for a personalized quote and contract
If the Client, acting in bad faith, misrepresents themselves as a private client but utilizes the commissioned artwork for commercial purposes, ownership of the work reverts to the Artist. The Artist reserves the right to pursue legal action to seek compensation equal to the Client's gross profits derived from the artwork.
5. Cancellation Policy:
If the Client cancels the commission before it is completed, the Artist reserves the right to retain the initial 50% deposit as compensation for time and resources.
If the Client cancels the commission after the artwork is completed, the Artist reserves the right to request payment of any remaining balance in full.
The artist reserves the right to terminate services at any time, for any reason.
No refunds will be issued by default; however, the artist reserves the right to reconsider on a case-by-case basis, such as if no progress has been made on the commission.
6. Timeline Extension:
The Artist reserves the right to extend the timeline of delivery if necessary, with prior notice to the Client.
7. Dispute Resolution:
In the event of any dispute arising from these Terms, both parties agree to attempt to resolve the matter through good faith negotiation. If resolution cannot be reached, either party may pursue legal remedies as permitted by US law.
8. Amendments:
These Terms may be subject to change at the discretion of the Artist. Any modifications will be communicated to the Client in writing.
If any part of the Terms is found to be unenforceable, the rest of the Terms will remain in effect.
By commissioning artwork from the Artist, the Client acknowledges that they have read, understood, and agree to abide by these Terms of Service.
